Terms and Conditions of Service

1. Introduction and Acceptance

Welcome to Bkard LLC. These Terms and Conditions govern the use of the digital business card creation, customization, and publishing service. By accessing the platform and proceeding with the creation and payment of your card, you fully accept these terms.

Our Mission: To empower professionals and businesses to connect seamlessly through innovative digital solutions, ensuring a transparent and secure experience.

2. Service Creation and Use

2.1 Service Model (No User Account Required)

Bkard LLC offers a digital card service based on an annual payment, without requiring the creation of a user account, password, or login process. The card is created using the information you share with us.

2.2 Trial Period and Payment

By creating your card, you gain access to a 7-day trial period with all functionalities active. Payment for the annual service is not recurring or automatic, and is made via payment link, PayPal, or Zelle.

2.3 Customer Responsibilities

You are responsible for providing accurate information and ensuring that all uploaded content (images, texts) complies with laws and does not infringe third-party rights (copyright or trademarks).

3. Intellectual Property

3.1 Customer Rights

You retain full ownership of the content you upload to your card (texts, images, logos, and other elements). Bkard LLC claims no ownership over your content.

3.2 Use of Content by Bkard LLC

You grant Bkard LLC a non-exclusive, royalty-free, worldwide license to host, reproduce, and display the content of your digital card as part of the contracted service. We may use your card’s content in promotional materials, portfolios, or marketing campaigns, absent an explicit written objection.

4. Service Termination (Annual Fee and Deactivation)

4.1 Duration and Renewal

The service is activated for an **annual period** starting from the payment date. Bkard LLC will send you a message (email/WhatsApp) 30 days in advance to inform you that your period is about to expire. Renewal is not automatic and requires a new annual payment before the expiration date.

4.2 Cancellation and Refund

Refunds are not offered for digital cards that have been published and activated. Payment is only processed after you confirm your satisfaction with the final design. If you choose not to proceed with publication, the card remains a draft and the annual fee is not applied.

4.3 Termination of Service due to Breach

Bkard LLC may suspend or terminate the publication of your digital card for violation of these terms, fraud, or misuse. We also reserve the right to deactivate the card if the provided information is false, misleading, or does not correspond to a real person/entity. You will be notified in case of termination.

5. Limitation of Liability

Bkard LLC is not responsible for damages or losses arising from the use or inability to use our services. We are not liable for errors or inaccuracies in the information you provide, nor for interruptions caused by factors beyond our control.

6. Governing Law and Entire Agreement

These Terms are governed by the laws of the country where Bkard LLC has its principal office. These Terms and the Privacy Policy of Bkard LLC constitute the entire agreement between the parties.
